In connection with incoming requests regarding the entry into force of paragraph 20 of Part 3 of Article 1 of FZ-102 "On Ensuring the Uniformity of Measurements" from 03/01/2025,
20) the production, use and circulation of precious metals and the extraction, use and circulation of precious stones;
We would like to inform you that when making decisions on assigning measurements performed by testing laboratories to the scope of state regulation established by paragraph 20 of Part 3 of Article 1 of Federal Law 102, one should be guided by Government Resolution No. 1295 of the Russian Federation adopted on September 24, 2024 "On Amendments to Government Resolution No. 1847 of November 16, 2020.
This Resolution approved amendments to the list of measurements related to the sphere of state regulation of ensuring the uniformity of measurements, approved by Decree of the Government of the Russian Federation dated November 16, 2020 No. 1847 "On Approval of the List of measurements related to the sphere of State Regulation of Ensuring the Uniformity of Measurements".
These changes are related to the adoption on 08.08.2024 of No. 232-FZ "On Amendments to Certain Legislative Acts of the Russian Federation and Invalidation of Certain Legislative Acts (Provisions of Legislative Acts) of the Russian Federation", containing amendments introduced into No. 102-FZ "On Ensuring the Uniformity of Measurements" and effective from 03/01/2025. Thus, the Government has already implemented the amendments made to No. 102-FZ, Article 1, Part 3, paragraph 20.
In particular, the list of measurements related to the sphere of state regulation of ensuring the uniformity of measurements has been supplemented by section 13 "Measurements in the production, use and circulation of precious metals and the extraction, use and circulation of precious stones". These measurements include measurements of the mass of refined precious metals, measurements of the mass of other precious metal products (except for measurements carried out to control technological processes, extraction of precious metals, geological exploration of the subsurface), as well as measurements of the mass of raw materials, scrap, waste and industrial products containing precious metals (except for measurements carried out for control purposes technological processes, extraction of precious metals, geological exploration of the subsurface).
Thus, geological work, extraction of precious metals and technological processes of production of precious metals do not belong to the sphere of state regulation.
